The following terms and conditions shall regulate the stay of the aircraft(s) of customers requesting the aircraft parking service, stay and/or overnight stay for hours or periods not exceeding 30 days (unless otherwise agreed), in hangar and/or apron located at ICCS facilities, at any of the airports where such service is provided within the territory of the United Mexican States. These terms and conditions shall also apply to any other additional service requested by the "User".
1.1.These Terms and Conditions constitute a legally binding contract, which establishes a contractual relationship between you, hereinafter referred to as the "User" and International Corporate & Cargo Services, S.A. de C.V., hereinafter referred to as "ICCS". If you do not agree to these Terms, you may not access or use the aforementioned Services.
By signing the “Walk Around” form, you agree to our Terms of Use and Privacy Policy, available here: https://www.iccs.com.mx/privacy-policy. You acknowledge that you have reviewed these terms and consent to the use of your information as described. We may use the email address you provide to send service-related notifications and may contact you through other appropriate channels when necessary.
"ICCS" may terminate any service or generally cease to offer or deny access to the Services or any part thereof, at any time and for any reason.
"ICCS" may make changes to the conditions relating to the services when it deems appropriate. The modifications will be effective immediately, and may be communicated to the "User" through the means of contact designated by the latter for the purposes of this service, or any other means determined by the parties. Even without such communication, the "User" is obliged to abide by them.
1.2.To terminate or rescind your contractual relationship with "ICCS" you must stop using all our "Services", pay any debts and immediately withdraw your aircraft(s).
2.1.The Services consist of aircraft parking, stay and/or overnight stay for hours or periods not exceeding 30 days (unless otherwise agreed), and/or any other additional service requested by the User.
Subject to your compliance with these Conditions, "ICCS" grants you a limited, non-exclusive, non-transferable right to: (i) access and use the "ICCS" Facilities only in connection with the service provided to you; and (ii) access and use the Facilities for aircraft-related matters, provided that it is a lawful and legal purpose under applicable aeronautical and federal regulations.
3.1.In order for "ICCS" to provide the Services, the "User" is obliged to provide certain information and/or personal documentation, which shall be contained in the form to be signed by the FBO in charge of the FBO on duty.
The "User" hereby declares that the information and/or documentation provided is accurate, complete and up to date. Failure of the "User" to keep the information and/or documentation accurate, complete and updated, including having an invalid or expired payment method, may result in his/her inability to access and use the Services. "ICCS" reserves the right to provide the service in case of refusal to provide the requested information and/or documentation.
Likewise, the "User" acknowledges that delivering and using false information and/or documents constitutes a crime, and therefore releases "ICCS" from any responsibility and accepts that it may cooperate when required with the airport, state, local and/or federal authorities in the event that before, during and after the provision of the Service, irregular situations arise or that may constitute illegal acts.
4.1."ICCS" will not operate under any circumstances the aircraft object of the Service, nor will it be able to enter inside such aircraft, and will only limit itself to the performance by its authorized representatives of the "walk around" of the aircraft, to verify the physical and mechanical condition in which the aircraft arrives at the "ICCS" facilities. Therefore, "ICCS" shall not be liable under any circumstances for indirect, incidental, punitive or consequential damages, including damage to the property of the aircraft owned or managed by the "User".
"ICCS" shall not be liable for loss, misplacement or damage to:
4.2.In addition to the provisions of the preceding paragraph, "ICCS" shall not be liable for any damage, liability or loss arising from:
(i) misuse of the services; or (ii) any transaction or relationship between you and any third party (iii) shall not be liable to the "User" in connection with any service provided to you by third party providers that results in damage to the aircraft or theft of any electronic, mechanical, computer, or other equipment within the aircraft.
4.3.In case the "User" requires the professional services of a third party with issues related to the operation of its aircraft, it must inform "ICCS" of the services that will be performed to its aircraft. Likewise, it is obliged to deliver the identity documentation of such third party, whether it is a passport, voting card, among others. In case the "User" refuses or does not deliver the required information and/or documentation, "ICCS" reserves the right to deny access to its facilities to any third party.
The "User" explicitly dissociates ICCS from the authorization and behavior of third parties that it authorizes for the performance of services related to its aircraft.
The "User" in this act releases "ICCS" from any criminal, civil, labor or any other liability that may arise by virtue of an improper use of the Service by the "User", collaborators of the "User", or persons authorized by the "User", directly or indirectly.
4.4.The "User" agrees to comply with applicable laws when using the Services and may only use the Services for lawful purposes.
4.5.During the development of the Services, the "User", its personnel, personnel authorized by it or any third party hired to perform activities inside the aircraft, is obliged not to cause interference in the operation of aircraft of other customers, or in the activity of the hangar, nor may cause inconvenience, discomfort or damage to property, both of "ICCS" and other customers of the hangar and adjacent facilities.
5.1.In order to guarantee the requested services, as well as any debt, damage or any other that may exist due to action or omission on the part of the "User" or third parties that contract or authorize its entry, the "User" shall deposit as a guarantee, the amount equivalent to $3,000.00 (Three thousand pesos 00/100 M/N.), whether it is delivered in cash or charged to a credit or debit card.
6.1.The "User" shall not: (i) modify, lease, resell, transfer, transmit, retransmit or otherwise exploit the Services, except when expressly permitted by "ICCS"; (ii) Perform activities not permitted, not informed and authorized by "ICCS" other than the Services; (iii) Perform improper or illegal operations of any kind; or (iv) Attempt to obtain unauthorized access either for the "User" or its personnel or any third party intending to damage or cause damage, using the services offered by "ICCS".
Any breach of this clause by the "User" will be cause for immediate cancellation of the service, and will be reported to the competent authority if applicable.
"ICCS" may notify any change, modification, adequacy, or any other communication concerning the Services, by means of an e-mail sent to the "User's" e-mail address or by written communication sent to its designated address, as provided in the information set forth in point four (4) of this contract.
No partnership, employment or agency relationship exists between the User and ICCS as a result of the provision of the Services.
If any provision of these Terms and Conditions shall be deemed unlawful, void or unenforceable, in whole or in part, under any law, such provision or portion thereof shall be deemed not to form part of these Terms and Conditions, although the legality, validity and enforceability of the remaining provisions shall not be affected.
These Terms and Conditions constitute the entire agreement and understanding between the parties relating to the subject matter of the Service.
Unless expressly stated otherwise, these Terms and Conditions shall be governed by and construed in accordance with the laws of the United Mexican States. Any dispute, conflict, claim or controversy shall be submitted to the Competent Courts of Mexico City.
